Online Fitness Program Terms & Conditions and Liability Waiver
By accessing and participating in the Eisel Elite LLC Fitness Program, you, the participant, agree to the following Terms & Conditions and acknowledge and accept the liability waiver as outlined below. Please read carefully.
1. Acknowledgment of Risk
I understand that participating in the fitness program offered by Eisel Elite LLC involves physical exercise, which can include, but is not limited to, strength training, stretching, cardiovascular workouts, and other activities that may carry inherent risks. I acknowledge that there are risks involved, including but not limited to, muscle strains, joint injuries, and more severe conditions such as heart attacks, strokes, or even death.
By checking the box below, I voluntarily agree to participate in the fitness program and accept full responsibility for any risks associated with my participation.
2. Health and Medical Disclaimer
I confirm that I am in good health and capable of performing the activities involved in this fitness program. I have no known medical conditions that would restrict my ability to safely engage in physical activities. I have consulted with a physician, if necessary, to ensure that I am fit for participation.
I will immediately notify Eisel Elite LLC if I experience any health issues during or after participation in the fitness program.
3. Personal Responsibility
I understand that it is my responsibility to monitor my physical condition during the fitness program. If at any point I feel discomfort, dizziness, pain, or other health-related issues, I agree to immediately stop the activity and seek medical attention if necessary.
4. Release of Liability
By checking the box below, I waive, release, and discharge Eisel Elite LLC, its employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action that may arise from my participation in the fitness program. This includes injuries or damages arising from my participation in the program, whether caused by negligence or otherwise.
I acknowledge that I am participating in this program at my own risk.
5. Indemnification
I agree to indemnify and hold harmless Eisel Elite LLC from any and all claims, losses, or damages, including legal fees, arising out of my participation in the fitness program. This indemnification applies to claims caused by my own actions or negligence.
6. No Guarantees
I understand that Eisel Elite LLC does not guarantee specific results or outcomes from the program, as results vary depending on individual effort, consistency, and adherence to the program. There are no guarantees of success, and my participation in the program is voluntary.
7. Media Release
I grant Eisel Elite LLC permission to use photographs, video recordings, or other media taken during my participation in the fitness program for promotional, educational, or marketing purposes. I understand that these media may be used on websites, social media platforms, or other promotional materials without compensation.
8. Termination of Access
Eisel Elite LLC reserves the right to revoke access to the program at any time for violations of the terms and conditions, inappropriate behavior, or if continued participation is deemed unsafe for the participant.
9. Governing Law and Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of Eisel Elite LLC. In the event of a dispute, both parties agree to resolve it through mediation/arbitration before pursuing any legal action.
10. Acceptance of Terms
By checking the box below, I confirm that I have read and understood the above terms and conditions and liability waiver. I acknowledge that I am voluntarily participating in the fitness program, and I agree to the terms outlined above. I also confirm that I am at least 18 years of age (or have the consent of a parent/guardian if under 18).
By selecting the checkbox, I agree to all the terms and conditions outlined in this liability waiver and release. I understand that by agreeing, I am waiving certain legal rights, including the right to sue, and I confirm that I am voluntarily participating in the online fitness program under these terms.
